Terms of Service

These Terms of Service ("Terms") govern your access to and use of Radar Mountain (the "Service"), operated by [LEGAL BUSINESS NAME — e.g., "Josh Lanius, sole proprietor" or your LLC name] of [BUSINESS ADDRESS] ("we," "us," "our"). By creating an account, starting a free trial, or subscribing, you agree to these Terms.
1. What Radar Mountain Is
Radar Mountain is a data and mapping tool that aggregates public building-permit and property records and presents them to trade contractors as a lead-prioritization aid. It is a research and planning tool. It is not:
- A guarantee that any specific project, permit, or dollar estimate is accurate, current, or will result in a sale;
- A verification of any contractor's licensing, insurance, or legal right to contact a property owner or builder;
- Legal, financial, or professional advice.
Dollar figures shown ("estimated package value," "hot," "upcoming," etc.) are planning estimates derived from public data and general assumptions about unit counts and project types. They are not appraisals, quotes, or promises of opportunity size. You are responsible for independently verifying any information before acting on it — including confirming you have a legal basis to contact any person or business shown.
2. Accounts
You must provide accurate information when creating an account. You're responsible for keeping your login credentials confidential and for all activity under your account. Accounts are for the use of the individual or business that purchased the subscription — sharing a single login across multiple companies or unrelated users is not permitted.
3. Subscriptions, Billing & Free Trial
- Trial: New subscriptions include a 3-day free trial. You will not be charged during the trial. You can cancel any time before the trial ends to avoid being charged at all.
- Price: The subscription is $99.99 per month (plus any applicable taxes) unless a different price is clearly shown to you before you subscribe. Pricing is shown in visual proximity to the signup button before you enter payment details, including the exact date your first charge will occur.
- Automatic renewal: After the trial, your subscription automatically renews and bills monthly to your payment method on file until you cancel. This is a continuous, automatically-renewing subscription under Tennessee law (Tenn. Code Ann. § 47-18-133), and you are giving affirmative consent to that recurring charge by completing checkout.
- Cancellation: You can cancel at any time. Cancelling stops future charges — it does not refund past ones (see our Refund Policy). To cancel, email josh.lanius@gmail.com or contact us using the details at the bottom of this page; we will confirm your cancellation and the date your access ends.
- Payment processing: All payments are processed by Stripe. We never receive or store your full card number.
- Failed payments: If a renewal payment fails and isn't resolved, your access may be suspended or your subscription cancelled.
4. Acceptable Use
You agree not to:
- Scrape, bulk-export, resell, sublicense, or redistribute data from the Service to anyone outside your own business;
- Share your login credentials with people outside your organization;
- Use the Service to violate any law, including telemarketing, harassment, or do-not-call regulations when contacting property owners or builders;
- Attempt to circumvent the Service's access controls or interfere with its normal operation.
We may suspend or terminate accounts that violate this section.
5. Data Sources & Accuracy
Radar Mountain relies on public records published by city and county governments and third-party data providers. These sources can be incomplete, delayed, or contain errors outside our control. We do our best to keep data current but make no warranty about its completeness, accuracy, or timeliness.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY LEAD, ESTIMATE, OR PIECE OF DATA IS ACCURATE.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM AROSE.
8. Termination
We may suspend or terminate your access if you violate these Terms, or discontinue the Service generally with reasonable notice. You may cancel at any time as described in Section 3.
9. Changes to These Terms
If we make a material change to these Terms or to your subscription terms, we'll give you clear notice and information on how to cancel before the change takes effect, consistent with Tennessee law.
10. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in [YOUR COUNTY] County, Tennessee.
